The United States comprises just 4% of the world’s population, yet it produces 25% of global Gross National Product (GNP), captures 65% of the world’s stock market value, provides the world’s reserve currency, and maintains the world’s strongest military. These achievements hinge on the strength of the U.S. economy, which depends on the continued growth and productivity of our workforce.

However, with birth rates below replacement levels and a shrinking domestic labor pool, the U.S. must rely on a robust legal immigration system to bridge the gap and ensure sustained economic growth.

The Challenge

In 2023, the foreign-born population in the U.S. exceeded 15% for the first time since the early 1920s. Historically, the political response to similar demographic shifts was to impose strict border controls, reducing the foreign-born population to just 5% by the early 1950s.

Today, we face a similar political climate, but our response must reflect modern realities. Unlike a century ago, the U.S. is suffering from low birth rates. Without immigration, our economic position and global leadership are at risk

  3. Humanely Address the Status of Unauthorized Immigrants: The approximately 11 million undocumented immigrants currently in the U.S. should not be left in limbo. Most of these individuals, including Dreamers, farm workers, and essential workers have contributed to the country and should have an earned path to legal status..

The United States faces a pivotal moment. To maintain our economic dominance and global influence, we must address workforce challenges through immigration reform. ABIC’s balanced approach—combining border security with a forward-thinking legal immigration system—provides a path to shared prosperity and national strength.

President Biden has announced two major changes to immigration policy to help people take advantage of immigration pathways:

  1. Undocumented immigrants with U.S. Citizen spouses maybe eligible for Parole in Place
  2. DACA recipients and DREAMers may be eligible for a D3 waiver

WHAT IS PAROLE IN PLACE?

  • When an immigrant marries a U.S. Citizen, they become eligible for a green card.
  • If the immigrant has entered the US without inspection, in order to get that green card, that immigrant must go back to their home country and apply through a U.S. consulate there.
  • Since 1996, someone who has been in the country without authorization for over 6-12 months automatically triggers a ban on re-entering the U.S. for 3-10 years.
  • Many immigrants cannot afford to leave their families to process the green card, so they have not adjusted their status.
  • Parole in place provides a lawful entry, and so allows many of them to adjust their status from inside the U.S. without having to return to their home country.

WHAT IS A D3 WAIVER?

  • A D3 waiver is a “forgiveness” from DHS for many kinds of immigration violations.
  • Examples of those violations include being unlawfully present in the U.S.
  • DACA recipients and DREAMers without DACA may have at least one of these violations since they were brought to the U.S. as children
  • These violations prevent DREAMers from changing their status through employer sponsorship.
  • A D3 waiver “forgives” unlawful presence so that a Dreamer can be sponsored by their employer for a temporary working visa (which can be an important step to a green card.
  • With the D3 waiver and temporary visa, the Dreamer is not dependent on DACA continuing.

WHO EXACTLY IS ELIGIBLE?

  • Unfortunately, we don’t know who exactly will benefit at this time. Biden announced the program on June 17, but the actual changes have not been written yet.
  • From the announcement we know DACA recipients and some other DREAMers without DACA may be eligible for d3 waivers.
  • We also know that undocumented spouses of U.S. citizens may be eligible for parole in place if they have been married since June 17, 2024 and have been living in the United States for 10 years.
  • Beyond that, we will need to wait for the final language from the agencies.

The SBA will resume accepting Paycheck Protection Program applications from participating lenders TODAY Monday, April 27, 2020 at 10:30am EDT. Over the weekend, a coalition of diverse advocates, social investors and minority lending experts sent a letter to Secretary Mnuchin and Administrator Carranza for a set-aside for businesses of color and smaller borrowers.You can read the letter and updated nameshere.

In summary, despitefrom Republican Small 91̽ Committee Chairman Marco Rubio, Democrat leaders Nancy Pelosi and Chuck Schumer, abroad and diverse coalitionof advocates, social investors, and minority business lending experts, and, reportedly, CEOs of Goldman Sachs and JP Morgan Chase, Secretary Steve Mnuchin has not agreed to a set aside for businesses of color and smaller borrowers. We will be watching to see if in the second round the big fish applicants will swallow up the PPP and leave out the small fry businesses without a dime.See CBS News Report:.

We were disappointed that Congress did not agree to this set aside for businesses of color and smaller borrowers last week. We are disappointed that Secretary Mnuchin has not acted this week. We could see a repeat of the first round. We will be watching all day.

In the meantime, this is what you can do to improve your chances today:

  1. Contact every bank you’ve applied for the PPP, even banks that ignored you in round 1. You may be in their queue.

FACT SHEET: SB 1822 Gruters/HB 1265 Byrd de facto “E-Verify” Legislation Mandates Private Employers Use of E-Verify or REAL ID

Introduced in the Florida legislature in January 2020, SB 1822/HB 1265 is a de facto E-Verify mandate on virtually every employer in Florida.If passed, this unfunded, anti-business mandate will effectivelyforce employers to do the government’s job for themby requiring every business in our state to use a federal system with a 12 percent error rate that has proven to beinefficient, inaccurate and ineffective. The end result of mandatory E-Verify in Florida would be the stifling of local businesses, decimation of the workforce, and devastation of our economy.

FORCES EMPLOYERS TO DO GOVERNMENT’S JOB & IMPOSES STEALTH TAX ON FLORIDA BUSINESSES TO COVER COSTS OF EXPANDED MANDATE

  • Forces Florida to set up its own duplicative, bureaucratic system of employment eligibility verification forevery person hiredand requires the state tooversee and authorize every single hiring decision made by every single private employer, in addition to the federal oversight already in effect.
  • Provides no resources to the hundreds of public entities burdened with compliance and enforcement under E-Verify expansion, making it anunfunded mandate, and shifts the government’s responsibility for verification to private businesses.
  • Effectively creates astealth taxon every Florida business and imposes a huge financial burden on local nonprofits & small businesses, such as convenience stores, home healthcare and assisted living businesses– costs which will ultimately be passed on to consumers.

PLACES ADDITIONAL REGULATIONS AND BURDENS ON PRIVATE & PUBLIC EMPLOYERS

  • Essentially mandates E-Verify by making it or other more onerous options, like REAL ID, mandatory for employment eligibility for private employers in the State of Florida.
  • Requires employment applicants to produce documents from an artificially narrowed list and prohibits them from choosing from among the existing federal list of acceptable documents. These requirements would apply to US Citizens, some of whom may not have a REAL ID driver’s license and therefore may risk losing their jobs although work authorized.
  • Duplicates existing regulations for state employees and contractors and expands them for all public entities including regional, county, municipal, school districts.

HARMS ALL FLORIDA RESIDENTS, INCLUDING CITIZENS & WORK-AUTHORIZED IMMIGRANTS

  • Gives employers the ability to violate federal law by using E-Verify to screen applications prior to the interview process and prior to a hiring decision being made, and does not afford the same rights to employees as to employers, including the right to challenge a decision.
  • Imposes criminal penalties on violators and narrows the list of acceptable documents a new employee can present, potentially in violation of federal law and opening the State up to lawsuits.
  • By requiring REAL IDs in order to comply with verification standards, negatively impacts documented Floridians who have not yet updated to a REAL ID, citizens returning from abroad, those with their driver’s licenses suspended, homeless residents, and other vulnerable communities in their efforts to secure gainful employment.
